Constructive Dismissal
Constructive dismissal refers to a situation where you were compelled or coerced to resign or made to feel like you had no other alternative but to resign from your job.
To claim constructive dismissal, you must be able to demonstrate some of the following circumstances:
-
Your employer might have suggested that it would be best if you resigned to resolve an issue. They could have made insinuations such as "Have you thought of finding another job?"
-
Alternatively, your employer's actions may have pressured you to quit. For instance, they may have changed your job responsibilities, leaving you with only uninteresting tasks. If this is your situation, you may be facing a technical redundancy. In that case, please refer to the redundancy section.
-
Employees find it challenging to claim constructive dismissal because the burden of proof rests with them. In contrast, in most other claims, the employer must justify their actions.
